The tiers most state maps are really showing
When I look at a legality map, I start by sorting states into four buckets. The bucket matters more than the color.

- No medical program. A small and shrinking group. Some of these states still allow certain low-THC extracts for narrow conditions, which is where maps get sloppy.
- CBD-only or low-THC programs. Usually capped at a small percentage of THC, often limited to a short list of conditions such as severe epilepsy. Access points are few. A card from one of these states may not get you into a full dispensary anywhere else.
- Comprehensive medical programs. Patient registry or card, qualifying condition list, licensed dispensaries, possession limits, and sometimes home cultivation. This is the category most people mean when they say medical is legal.
- Medical plus adult use. Medical patients still get their own lane, often with higher possession limits, lower taxes, or access before a store opens to the general market. Adult-use status does not automatically make medical rules irrelevant.
The federal layer the map leaves out
Cannabis is still a Schedule I controlled substance under federal law, and the FDA has not approved botanical cannabis as a medicine. A handful of cannabis-derived prescription drugs exist, but they are a separate thing from the flower and gummies in a state dispensary. That gap is why a state map alone will mislead you.

Federal rescheduling has been under review for a while, and it may or may not finish. Until a final rule lands, the practical picture is state law and federal law running in parallel. An appropriations rider has blocked the Justice Department from using funds to interfere with state medical programs, which is why the system functions at all. What to check before you trust any map
Maps are snapshots and they age fast. These are the fields I verify against the state's own program page:
- Qualifying conditions. Some states list fifteen or more. Others list a handful. A few let a physician use discretion.
- Patient registry. Is a state card required to buy, or does a recommendation alone work? Some states have no registry at all and simply treat a physician's authorization as the ticket.
- Reciprocity. Out-of-state medical cards are honored in some states and ignored in most. Never assume.
- Possession limits. Look at flower, concentrate, and edibles separately. Many states cap them independently, and a two ounce headline can hide a concentrate limit that is much smaller.
- Cultivation and caregivers. Allowed in some states, flatly banned in others, and the plant counts differ.
- Where you can buy. A legal program with three dispensaries in the whole state is legal on paper and inconvenient in practice.
Why the map keeps moving
State legislatures change cannabis rules almost every session. Ballot initiatives add states in even years. Agencies rewrite possession limits and product caps with little fanfare. I check two sources on a schedule: the National Conference of State Legislatures for program structure, and NORML for the operational details like conditions and limits. Anything older than one legislative session is worth re-reading.
The practical takeaway
Use a legality map to get oriented, then read the specific state's program rules before you buy, travel, or renew a card. Legality is not portable. Your card is a permission slip from one state, and it expires at the border.
