If you are 21 or older, California lets you grow up to six cannabis plants at a private residence for personal use. That is the statewide ceiling set by Proposition 64, the Adult Use of Marijuana Act. It is a ceiling, not a guarantee. Your city, your county, and your landlord can all take that number down, and some take it to zero.

Six plants per residence, not per person
This is the mistake I see most often. The cap applies to the property, not to the people living on it. Four adults sharing a house do not get 24 plants. They get six, total, at one time.

The word "residence" matters too. A backyard counts. A rented duplex counts. A vacant lot does not, and neither does a community garden plot. The grow has to be at a private residence, on the grounds of that residence, and not visible from a public place without binoculars or a ladder.
Medical patients get a different number
Under Proposition 215 and SB 420, a patient with a valid doctor's recommendation, or a designated caregiver, can cultivate six mature or twelve immature plants by default. A physician can recommend a higher number in writing, and that recommendation carries weight.
It is not unlimited, though. Local ordinances still apply to medical grows, and a city that bans cultivation generally bans it for patients too unless the ordinance says otherwise.
Your city or county can shrink that number
California hands cultivation rules to local governments, and they use that power. Some cities allow outdoor grows with fencing and screening. Some allow indoor grows only, sometimes with a permit and a fee. Some prohibit personal cultivation entirely.
The practical move is to open your city's municipal code and search for the word "cultivation." If nothing comes up, call the planning department and ask directly. I do this before buying a single pot, because the statewide six-plant rule does not help you if your city says four, or none.
Rules that apply no matter where you live
- The plants must be in a locked space and not visible from public view.
- You cannot sell what you grow. Unlicensed sales are a crime, not a gray area.
- Gifting to another adult 21 or older is allowed as long as no money or goods change hands.
- Your landlord can ban cultivation in the lease, and many do.
- Cannabis remains illegal under federal law, so do not carry plants or flower across state lines or into an airport.
- Public possession is capped at 28.5 grams of flower or 8 grams of concentrate.
Do clones and seedlings count?
The statute counts living plants, so rooted clones and seedlings count toward your six. Treat anything with roots and green tissue as a plant and you will stay on the safe side. Cuttings sitting in water with no roots yet are a murkier question, and no one wants to be the test case.
A quick way to check your own situation
- Are you 21 or older, or a patient with a current recommendation?
- Is the grow at a private residence where you live or have permission to cultivate?
- What does your city or county ordinance say about cultivation?
- What does your lease say?
- Can you keep the plants locked and out of public view?
If all five answers line up, six plants is your number, unless local rules give you more.
Growing versus buying
Six plants sounds generous until you price out lights, soil, nutrients, and the four months of attention a decent harvest takes. A single outdoor plant can yield several ounces, so most people find six is far more than they need for a year of personal use.
If the grow is more project than you want, buying from a licensed retailer is the simpler and fully legal route. Home cultivation is a nice option to have, not an obligation.
