Law: the 2018 Farm Bill caps delta-9 THC in hemp at 0.3% on a dry weight basis. Above that cap, the plant is cannabis under federal law, Schedule I. Licensed state markets sell it with age checks, batch testing, and dose labels.

Delta-8 THC

Delta-8 THC comes from CBD. Plants make little of it. Chemists convert CBD with solvents and acid. The result binds CB1 receptors with lower affinity than delta-9, so users report a milder effect. Tests of store products found label gaps. Some items held more delta-9 THC than the label listed.

Law: delta-8 sits in a gray zone. The 0.3% delta-9 cap does not cover it. About 20 states ban or restrict it. The FDA has not approved delta-8 THC for any use and has sent warning letters to sellers.

Safety: poison control calls about delta-8 rose after 2021, with cases in children and adults. Long-term human data does not exist.

How to Pick

Check your state law before you buy. Ask for a certificate of analysis (COA). The COA needs separate numbers for delta-8 and delta-9, plus a pesticide panel. Start low. A common starting edible dose is 5 mg delta-9 or 2.5 mg delta-8. Wait two hours before a second dose. Note: effects of delta-8 in humans over years are not known.
