There is no single U.S. cannabis workplace drug test law. What you can be tested for, and what an employer can do with the result, comes down to three things: the federal rules attached to the job, the state where you work, and the employer's own written policy. Marijuana is still a Schedule I controlled substance under federal law, so commercial drivers under DOT rules, most federal employees, and federal contractors can be tested and removed for a positive result even in a fully legal state. Meanwhile, about a dozen states plus the District of Columbia have passed laws limiting pre-employment THC testing or barring discipline for off-duty use, with few exceptions carved out for safety-sensitive work.

Several states with decades-old medical programs offer no protection at all for adult use, and at-will employment still means an employer can end the relationship for any reason that is not illegal.

Medical cannabis and accommodation

This is the messiest corner of the topic. A positive result tells you someone used at some point, not that they are high now.

  • Urine: 1 to 3 days after occasional use, 30 days or more for daily users
  • Oral fluid: about 24 to 48 hours
  • Hair: up to 90 days
  • Blood: hours to a day or two

CBD products are a wild card. Some carry enough THC to trigger a positive, and labels are not always accurate. Only labs certified by the federal government may run tests for federally regulated programs, and even those confirm a metabolite, not a state of mind.

Policy language and reasonable suspicion

Most states that protect off-duty use still allow testing when there is reasonable suspicion of impairment at work, or after a workplace accident. The definition of reasonable suspicion usually lives in the employer's policy, and vague language in a handbook tends to favor the employer. In some states, a written promise not to test for THC can create an obligation the employer has to honor. I look for the words safety-sensitive and reasonable suspicion first, because they decide most of these cases.

Practical steps if you use cannabis off the clock

  1. Read the drug testing section of your handbook before you need it
  2. Check whether your state has an off-duty use protection law and what it excludes
  3. Confirm whether your role is classified as safety-sensitive, since that decides most disputes
  4. Do not assume a medical card protects you under DOT or federal contractor rules
  5. Ask what happens to a positive result before you volunteer information
  6. If you get a positive result and think state law covers you, respond fast, because appeal deadlines are short

Employers, for their part, should know that a zero-tolerance policy written in 2015 may now be unenforceable in the state where they operate. Reviewing testing policy against current state law is cheaper than defending a wrongful termination claim.
