Cannabis Possession Limits in Public: State Rules
The short answer
There is no national cannabis possession limit for public places. The federal government still classifies cannabis as a controlled substance, so every number you see comes from state law, and the states do not agree with each other. In adult-use states, the public limit is usually the same as or a bit lower than the home limit, and the container matters as much as the weight. Most of those same states also ban smoking or vaping in public, even when carrying a sealed product is legal.
Public limit vs. home limit
A few states let you keep more at home than you can walk around with. Examples for adults 21 and older, current as of this writing:
- California: 28.5 grams of flower or 8 grams of concentrate, at home or out. Public consumption is prohibited.
- Massachusetts: 1 ounce in public, up to 10 ounces at home. The extra at home has to stay secured.
- Nevada: 1 ounce of flower or one eighth of an ounce of concentrate. Public use is limited to licensed consumption lounges.
- Illinois: 30 grams of flower for residents, 15 grams for visitors, and it must be sealed and odor-proof in public or in a vehicle.
- New York: 3 ounces of flower or 24 grams of concentrate, and adults may smoke wherever tobacco smoking is allowed.
States without adult-use legalization work differently. Florida allows registered medical patients a capped amount of flower per 35-day period and nothing for everyone else. Texas has a narrow medical program and still treats most possession as a criminal matter.
Packaging counts as much as weight
A legal amount in the wrong container can still get you cited. Most states borrow the open container idea from alcohol law: cannabis in a vehicle or in public has to be sealed and unopened, ideally in the child-resistant package it came in. Cracking the jar to smell it at a trailhead, passing a joint on a boardwalk, or leaving a half-smoked pre-roll in the cupholder turns a legal amount into a violation.
What I tell people at the counter: buy what you plan to use, keep it sealed until you are somewhere private, and treat the trunk as the only safe storage spot on the drive home.
Where public is wider than people expect
Public means more than a sidewalk. It generally covers parks, beaches, parking lots, festival grounds, hotel lobbies, stairwells, and the front seat of a parked car. A few places catch people off guard:
- Federal land. National parks, national forests, Bureau of Land Management acreage, and Corps of Engineers lakes follow federal law. A state-legal ounce in your backpack is a federal offense there.
- Airports and aircraft. TSA screens for threats rather than flower, but local police at a checkpoint can enforce state and federal rules.
- Tribal land. Tribal governments set their own rules, and those rules do not have to match the surrounding state.
- School zones. Several states add enhanced penalties for possession within a set distance of a school or daycare.
- State lines. Carrying cannabis across a border is a federal crime, even between two legal states.
City and county rules stack on top
Local ordinances can be stricter than state law. Some towns ban public consumption outright, some allow licensed lounges, and some restrict where shops can operate. A state-level yes on carrying an ounce does not guarantee a city-level yes on lighting up in the park.
What happens if you go over
Penalties scale with weight and intent. A small overage is often an infraction with a fine. Larger amounts, or anything that looks like distribution, can be a misdemeanor or felony with jail time. Repeat offenses and possession near schools carry heavier consequences in most states.
A quick checklist
- Look up your state's public limit, not just the home limit.
- Keep the product sealed in its original packaging.
- Store it in the trunk, not the glove box, on the drive home.
- Skip smoking or vaping in public unless your state allows it.
- Leave it at home before a national park trip or a drive across state lines.
- Buy from a licensed shop so you know the weight and the source.
