The short answer

As of early 2025, 24 states and Washington, D.C. let adults 21 and older buy and possess cannabis for fun rather than medicine. Around 40 states allow medical cannabis in some form, though a few cap it at low-THC oils. Four states still ban it outright. Any map you find is a snapshot, not a promise, since this list keeps growing with each election cycle.

Adult-use states

These states have legalized recreational possession for adults and, in most of them, retail sales through licensed shops.

Virginia is the odd one out. Possession and small home grows are legal, but retail stores have not opened statewide. Delaware and Minnesota are mid-rollout too, so a legal state does not always mean a dispensary on the next corner.

Medical-only states

These states have no adult-use market but run full medical programs: Arkansas, Florida, Hawaii, Louisiana, Mississippi, New Hampshire, North Dakota, Oklahoma, Pennsylvania, South Dakota, Utah, and West Virginia. Several others run narrow programs limited to low-THC extracts, including Alabama, Georgia, Iowa, Kentucky, and Texas, while a few more allow CBD with only trace amounts of THC.

Your medical card does not travel. Most medical states require residency and a card issued in that state, so an out-of-state card usually gets you nothing at the counter.

Where cannabis is still fully illegal

Idaho, Kansas, South Carolina, and Wyoming have no medical or adult-use program at all. Nebraska voters approved a medical measure in 2024, and the rollout has been slow and tangled up in court. Penalties vary widely everywhere else: a small amount that is a ticket in one state can mean jail time in another.

Possession, sales, and home grow are three separate questions

Legal states do not agree on the fine print, and the fine print is what actually matters if you get stopped.

• Possession limits usually run from 1 to 3 ounces in public, with more allowed at home.
• Home grow is allowed in roughly half the legal states, often six plants or fewer per adult.
• Retail sales are taxed and tracked. Buying from a friend is still illegal in most places.
• No state permits driving while impaired, and open-container rules apply to cannabis too.

Crossing a state line

Federal law still treats cannabis as a controlled substance. Moving it across state borders, even between two legal states, is a federal offense. Airports and border checkpoints sit on federal ground. That is the part travelers get wrong most often, and it is the one with real consequences.

How to check before you go

Start with the state's own regulatory site instead of a blog or a map graphic. Then confirm three things: the possession limit, whether shops are actually open near where you're staying, and whether your out-of-state ID works. Bring a government ID and cash, since plenty of dispensaries still cannot process cards.
