Does federal law allow cannabis to cross state lines?
No. Cannabis is a Schedule I controlled substance under the federal Controlled Substances Act (CSA), and moving it across a state border is a federal crime. A license from one state to grow, sell, or test cannabis gives that business no legal protection in any other state.

Why state legalization stops at the state line
States regulate cannabis under their own police powers. Federal law sits on top of that and does not defer to state programs.

- Schedule I status. 21 U.S.C. § 812 places marijuana in Schedule I, alongside heroin and LSD. Schedule I drugs cannot be prescribed, and the CSA treats their distribution as trafficking.

Hemp is the exception
The 2018 Farm Bill removed hemp from the CSA. Hemp is defined as cannabis with a delta-9 THC concentration of 0.3% or less on a dry weight basis, and it can move across state lines under federal law.
States still set their own rules. A state may restrict hemp products sold inside its borders, and many states now ban intoxicating hemp compounds outright.
Does the Rohrabacher-Farr amendment protect interstate shipments?
No. That appropriations rider, now often called the Rohrabacher-Blumenauer or Joyce amendment, blocks the Justice Department from spending funds to stop states from carrying out their medical cannabis laws. It is a spending limit, not a legalization of transport.
The rider also covers medical programs, not adult-use sales. It says nothing about product moving between states.
What about rescheduling and federal bills?
Federal reform has not reached interstate commerce. The DEA proposed moving cannabis to Schedule III, a step that would change tax and research rules but would not legalize shipments between states.
The MORE Act passed the House twice and did not become law. The SAFE Banking Act passed the House several times and stalled in the Senate. Until a bill passes both chambers and gets signed, interstate cannabis commerce stays illegal.
Two federal rules that hit interstate operators
IRS Code 280E bars deductions for expenses from trafficking in Schedule I or II drugs, so a cannabis business cannot write off rent, payroll, or marketing on its federal return. A company with farms in three states cannot file one consolidated return that fixes the problem.
Banking limits trace to the same Schedule I status. Many banks treat cannabis deposits as high risk, which pushes interstate operators toward cash and makes the money laundering exposure worse.
Where federal law applies even inside a legal state
- National parks and forests, plus other federal land.
- Airports and any federally controlled property.
