- Descheduling means removing cannabis from the Controlled Substances Act entirely. No schedule, no federal prohibition. Think alcohol and tobacco: legal, taxed, regulated, but not a controlled substance.
- Rescheduling to Schedule III means cannabis stays a controlled substance but moves down the ladder. Schedule III drugs have recognized medical use and lower abuse potential. It would not legalize adult use nationally.
The DEA's proposal is the second one. If you see "descheduling" in a headline about the 2024 proposal, the headline is wrong.
The paper trail
- 2023: HHS finished a scientific review and recommended Schedule III.
- May 2024: DEA published a proposed rule in the Federal Register to make that change, which opened a public comment period.
- Late 2024: DEA scheduled an administrative hearing, with designated participants arguing both sides.
- 2025: the hearing process slowed and stalled. No final rule has been published.
Why an administrative hearing drags
A DEA scheduling hearing is not a trial. No jury, no criminal defendant. An administrative law judge presides, a limited set of participants presents evidence and cross-examines, and the judge builds a record. The final call sits with the DEA Administrator, not the judge. Add that any final rule will get challenged in federal court, and you get a process measured in years, not months. That is normal under this statute. It is not a sign that something broke.
What would actually change
- 280E goes away. That is the tax rule blocking state-legal cannabis businesses from deducting ordinary business expenses. This is the biggest real-world effect.
- Research gets easier. Schedule I adds registration and security layers that slow clinical work.
- Banking does not get fixed. That is a separate fight in Congress.
- State programs keep running. Rescheduling does not override state law, and it does not make cannabis legal in states that ban it.
- Adult-use legalization does not happen. Schedule III is still controlled.

Nothing at the counter changes. Your purchase is governed by state law, and the federal proposal adds or removes nothing from your state's rules. If you are a medical patient, your card and your dispensary access work the same way they did before the proposal existed. The place this matters most right now is business and tax planning, not retail.
What to watch
One document: a final rule in the Federal Register. Anything short of that is a step, not an outcome. Second, the DEA Administrator, who signs the final order. Third, litigation, because a rule this size gets challenged no matter which way it goes. Congressional bills that would deschedule cannabis outright are a separate track on their own timeline.
