Airport security in the United States is a federal operation. TSA officers screen for threats to aviation. TSA states that its officers do not search for marijuana or other drugs. When a screening officer finds cannabis, TSA hands the case to local law enforcement. The outcome depends on the state, the airport, and the amount.

The Federal Layer
Cannabis is a Schedule I substance under the federal Controlled Substances Act. Simple possession is a federal misdemeanor under 21 U.S.C. 844. Moving cannabis from one state to another can be charged as distribution under 21 U.S.C. 841. Airspace, security checkpoints, and interstate flights fall under federal jurisdiction. A state medical card is not a defense in federal court.

What TSA Does at the Checkpoint
TSA screens bags for weapons and explosives. Cannabis appears on X-ray images as organic material. An officer can open a bag when the image is unclear. If cannabis is found, the officer calls airport police or city police. TSA does not keep the product. The local agency decides the next step: a citation, an arrest, or no action.

States With Legal Adult Use
As of 2025, 24 states and the District of Columbia allow adult-use cannabis. 38 states run medical programs. State law governs the terminal, but airport property rules add limits.
- California: adults 21 and over can carry 28.5 grams of flower and 8 grams of concentrate. Los Angeles International Airport and San Francisco International Airport hand cannabis cases to local police. Small personal amounts often end with no arrest.
- Colorado: adults can carry 2 ounces. Denver International Airport bans cannabis on its property and places amnesty boxes before the checkpoints.
- Washington: adults can carry 1 ounce of flower. Seattle-Tacoma International Airport is owned by the Port of Seattle and bars cannabis on the property.
- Nevada: adults can carry 1 ounce. Harry Reid International Airport sits on Clark County land and bars cannabis from the terminals.
- Oregon, Arizona, Illinois, Massachusetts, Michigan, New York: adult use is legal statewide. Airports in these states pass cases to local police. A checkpoint find can still bring a citation.
Medical-Only States
In states with medical programs only, possession without a valid card is a state crime. A card does not shield a traveler at a federal checkpoint. Florida permits medical cannabis for state cardholders, but terminals and aircraft fall under federal rules. Texas allows low-THC cannabis oil for a short list of conditions. Other cannabis products remain illegal in Texas.
States With No Legal Cannabis
In states where all cannabis is illegal, airport police can arrest for possession. Penalties range from a fine to jail time. Idaho, Kansas, South Carolina, Tennessee, and Wyoming are examples. A small amount can still mean a misdemeanor charge and a court date in the destination state.
CBD and Hemp Products
TSA permits hemp-derived CBD in carry-on and checked bags when the product contains 0.3% THC or less on a dry weight basis. Anything above that limit is treated as cannabis. State labeling rules differ, so a product legal at home may not be legal at the destination.
Checked Bags and Aircraft
Federal law applies in the air. Flight crews and air marshals can report possession. Airlines set their own carriage rules and can deny boarding. A bag that crosses a state line can be sent to federal agents. Amtrak trains operate under federal jurisdiction and ban cannabis. National parks and federal buildings ban it as well.
What Happens After a Find
- TSA finds the item and calls local police.
- Local police apply state law and the amount involved.
- The officer issues a citation, makes an arrest, or takes no action.
- Federal charges can follow if the case involves interstate transport or a large amount.
