Why state legalization doesn't follow your car
State cannabis laws are written to govern conduct inside that state, and most legal states say plainly that product bought there may not leave. California allows an adult to carry up to an ounce, and its rules stop at the state line. Nevada, Oregon, Massachusetts, and others have similar limits. So the buyer can be fully compliant at 4 p.m. and a criminal suspect at 4:20 p.m. ten miles down I-80.

Federal law never moved. Cannabis sits at Schedule I of the Controlled Substances Act, the same tier as heroin and LSD. A first federal possession conviction carries up to a year in prison and a fine. Add weight, and prosecutors can pursue trafficking charges with mandatory minimums attached.
What a traffic stop can turn into
- State troopers and local police enforce their own state's law. Carry legal Washington flower into Idaho and you are now in a state where any amount is a crime, a misdemeanor at small quantities and a felony as weight climbs.
- Federal officers can stop you too. Border Patrol works within 100 miles of any border, including coastlines, and runs interior checkpoints in places like southern Arizona and south Texas. Those stops run on federal rules.
- Ports of entry and any Customs and Border Protection interaction are federal. CBP does not recognize a state medical card.
- Airports are not a loophole. TSA screens for security threats, not drugs, but the standard practice when a screener finds cannabis is to hand it to local law enforcement. Whether that becomes a charge depends on the state the airport sits in.
- Impaired driving is a separate offense everywhere, legal state or not. If an officer smells burnt cannabis and you fail a field sobriety test, what's in the trunk matters much less than what's in your blood.
Federal land is its own trap
National parks, national forests, military bases, and many monuments follow federal law. Yosemite, Yellowstone, and Shenandoah all sit in states with some form of legal cannabis. All of them are federal property. Possession there is a federal crime regardless of which state you drove through to reach the gate. Rangers write those tickets.
What about hemp and CBD?
Hemp-derived products with no more than 0.3 percent delta-9 THC on a dry weight basis are federally legal under the 2018 Farm Bill. Some states accept that framework. Others have banned hemp-derived intoxicants outright or capped them tightly. A bottle of CBD in your console is a different legal question than a jar of flower, but it is not a free pass. Check the state you're entering before you pack it.
If you're planning a road trip
- Buy in the state where you're staying. Consume there. Leave the rest there.
- Do not carry it across a border, not even a short hop between two legal states.
- Driving through a state where it's illegal means a routine stop can become a search and a charge.
- Keep it out of reach while driving and never in an open container. DUI enforcement in legal states is real.
- On federal land, assume federal rules and leave it at home.
